If you do not agree with these Terms, please do not use Apta.<\/p>\n<hr \/>\n<h2>1. About Apta<\/h2>\n<p>Apta is a technology platform designed to help customers <strong>find, discover, compare, and connect with individual service providers, professionals, freelancers, creators, local suppliers, domestic helpers, and other providers<\/strong>.<\/p>\n<p>Depending on the features available, Apta may allow users to:<\/p>\n<ul>\n<li>Search for service providers<\/li>\n<li>Browse provider profiles<\/li>\n<li>View provider information and verification badges<\/li>\n<li>Search by category, service, location, language, or other criteria<\/li>\n<li>Contact service providers<\/li>\n<li>Use in-app communication features<\/li>\n<li>Submit service requirements<\/li>\n<li>Request quotes<\/li>\n<li>Receive and compare quotes<\/li>\n<li>Leave ratings and reviews<\/li>\n<li>Save or shortlist providers<\/li>\n<li>Manage their own profile<\/li>\n<\/ul>\n<p>Apta primarily acts as a <strong>technology and discovery platform connecting customers and service providers<\/strong>.<\/p>\n<p>Unless specifically stated otherwise, Apta does not itself provide the services listed by individual providers.<\/p>\n<hr \/>\n<h1>2. Eligibility<\/h1>\n<p>You must be legally capable of entering into a binding agreement under applicable law to use Apta.<\/p>\n<p>By using Apta, you represent that:<\/p>\n<ul>\n<li>The information you provide is accurate and current.<\/li>\n<li>You will use Apta only for lawful purposes.<\/li>\n<li>You will comply with these Terms and applicable laws.<\/li>\n<li>You will not use another person&#8217;s identity or account without authorization.<\/li>\n<li>You will not knowingly provide false or misleading information.<\/li>\n<\/ul>\n<p>If you are using Apta on behalf of a business or organization, you confirm that you have authority to represent that entity.<\/p>\n<hr \/>\n<h1>3. User Accounts<\/h1>\n<p>Certain Apta features may require you to create an account.<\/p>\n<p>You are responsible for:<\/p>\n<ul>\n<li>Providing accurate information<\/li>\n<li>Keeping your login credentials secure<\/li>\n<li>Keeping your profile information updated<\/li>\n<li>Maintaining the confidentiality of OTPs and authentication information<\/li>\n<li>All activity occurring through your account<\/li>\n<\/ul>\n<p>You must notify Apta promptly if you believe your account has been accessed without authorization.<\/p>\n<p>Apta may suspend or restrict an account where we reasonably believe that the account is being used fraudulently, unlawfully, abusively, or in violation of these Terms.<\/p>\n<hr \/>\n<h1>4. Customer Accounts<\/h1>\n<p>Customers may use Apta to search for providers and communicate with them.<\/p>\n<p>Customers are responsible for:<\/p>\n<ul>\n<li>Providing accurate service requirements<\/li>\n<li>Providing accurate location information where required<\/li>\n<li>Reviewing provider information before engaging a provider<\/li>\n<li>Communicating requirements clearly<\/li>\n<li>Confirming prices, scope, materials, timelines, and other terms directly with the provider<\/li>\n<li>Making their own decision regarding whether to engage a provider<\/li>\n<\/ul>\n<p>Apta does not guarantee that a provider will accept a customer&#8217;s request or provide a service.<\/p>\n<hr \/>\n<h1>5. Service Provider Accounts<\/h1>\n<p>Service providers may create profiles to showcase their services and receive customer enquiries.<\/p>\n<p>Providers are responsible for ensuring that their profiles contain accurate and lawful information, including:<\/p>\n<ul>\n<li>Name<\/li>\n<li>Services offered<\/li>\n<li>Experience<\/li>\n<li>Qualifications<\/li>\n<li>Service area<\/li>\n<li>Pricing information<\/li>\n<li>Availability<\/li>\n<li>Portfolio information<\/li>\n<li>Contact information<\/li>\n<li>Verification information, where applicable<\/li>\n<\/ul>\n<p>Providers must not:<\/p>\n<ul>\n<li>Misrepresent their qualifications<\/li>\n<li>Claim certifications they do not possess<\/li>\n<li>Use another person&#8217;s identity<\/li>\n<li>Upload misleading photographs<\/li>\n<li>Publish fraudulent information<\/li>\n<li>Advertise services they cannot legally provide<\/li>\n<li>Make false claims about their experience or capabilities<\/li>\n<\/ul>\n<p>Apta may review, restrict, modify, suspend, or remove provider profiles that violate these Terms or applicable law.<\/p>\n<hr \/>\n<h1>6. Apta Is Not the Service Provider<\/h1>\n<p>Apta is a platform that facilitates discovery and communication between customers and independent service providers.<\/p>\n<p>Unless expressly stated otherwise:<\/p>\n<ul>\n<li>Apta does not employ service providers.<\/li>\n<li>Apta does not supervise service providers.<\/li>\n<li>Apta does not control how a provider performs a service.<\/li>\n<li>Apta does not determine the final price charged by a provider.<\/li>\n<li>Apta does not guarantee the quality, availability, legality, safety, qualifications, or conduct of a provider.<\/li>\n<li>Apta does not guarantee that a provider will complete a service.<\/li>\n<li>Apta does not guarantee that information supplied by a provider is completely accurate.<\/li>\n<\/ul>\n<p>The agreement for the actual service is generally between the <strong>customer and the service provider<\/strong>.<\/p>\n<p>Customers should independently evaluate a provider before engaging them.<\/p>\n<hr \/>\n<h1>7. Provider Verification<\/h1>\n<p>Apta may provide verification features such as:<\/p>\n<ul>\n<li>Identity verification<\/li>\n<li>Aadhaar-related verification<\/li>\n<li>Driving licence verification<\/li>\n<li>Mobile verification<\/li>\n<li>Email verification<\/li>\n<li>Social profile verification<\/li>\n<li>Professional verification<\/li>\n<li>Other verification badges<\/li>\n<\/ul>\n<p>A verification badge indicates that Apta or an applicable verification partner completed a particular verification process according to the applicable criteria.<\/p>\n<p>Verification does <strong>not<\/strong> constitute a guarantee, recommendation, certification, endorsement, or warranty of the provider or their services.<\/p>\n<p>A verification status may be removed, suspended, or expire where appropriate.<\/p>\n<hr \/>\n<h1>8. Provider Profiles and Search Results<\/h1>\n<p>Apta may display providers based on factors such as:<\/p>\n<ul>\n<li>Category<\/li>\n<li>Service<\/li>\n<li>Location<\/li>\n<li>Search terms<\/li>\n<li>Availability<\/li>\n<li>Profile information<\/li>\n<li>Verification status<\/li>\n<li>User activity<\/li>\n<li>Reviews and ratings<\/li>\n<li>Relevance to a customer&#8217;s request<\/li>\n<li>Other platform-related factors<\/li>\n<\/ul>\n<p>Search results and rankings may change over time.<\/p>\n<p>A provider appearing higher or lower in search results does not necessarily indicate that Apta recommends or endorses that provider.<\/p>\n<hr \/>\n<h1>9. Ask for Quote<\/h1>\n<p>Apta may provide an <strong>Ask for Quote<\/strong> feature through which customers can submit a service requirement to one or more relevant providers.<\/p>\n<p>A quote may include:<\/p>\n<ul>\n<li>Price<\/li>\n<li>Starting price<\/li>\n<li>Estimated cost<\/li>\n<li>Labour charges<\/li>\n<li>Material charges<\/li>\n<li>Inspection requirements<\/li>\n<li>Estimated timeline<\/li>\n<li>Other terms proposed by the provider<\/li>\n<\/ul>\n<p>Quotes are submitted by providers and are not necessarily created, verified, or guaranteed by Apta.<\/p>\n<p>Customers should review all quote details carefully before accepting a provider&#8217;s offer.<\/p>\n<p>Unless otherwise stated, a quote does not automatically create a contract between the customer and provider.<\/p>\n<p>The final scope, price, materials, timeline, payment terms, cancellation terms, and other conditions should be agreed directly between the customer and provider.<\/p>\n<hr \/>\n<h1>10. Prices and Payments<\/h1>\n<p>Unless Apta specifically provides an integrated payment feature, Apta does not process or guarantee payments between customers and service providers.<\/p>\n<p>Prices displayed on provider profiles or in quotes may:<\/p>\n<ul>\n<li>Change<\/li>\n<li>Be estimates<\/li>\n<li>Exclude materials<\/li>\n<li>Exclude transportation<\/li>\n<li>Exclude taxes<\/li>\n<li>Depend on inspection<\/li>\n<li>Depend on the final scope of work<\/li>\n<\/ul>\n<p>Customers should confirm the final price and applicable charges directly with the provider before starting work.<\/p>\n<p>Where Apta introduces payment functionality in the future, additional payment terms may apply.<\/p>\n<hr \/>\n<h1>11. Communication Between Users<\/h1>\n<p>Apta may provide:<\/p>\n<ul>\n<li>Chat<\/li>\n<li>Call<\/li>\n<li>Query forms<\/li>\n<li>Quote requests<\/li>\n<li>Notifications<\/li>\n<li>Other communication tools<\/li>\n<\/ul>\n<p>Users must use these features responsibly.<\/p>\n<p>You must not use Apta communication features to:<\/p>\n<ul>\n<li>Harass or threaten another person<\/li>\n<li>Send spam<\/li>\n<li>Distribute malware<\/li>\n<li>Send unlawful content<\/li>\n<li>Share fraudulent offers<\/li>\n<li>Conduct scams<\/li>\n<li>Promote illegal activities<\/li>\n<li>Collect personal information without authorization<\/li>\n<li>Circumvent Apta&#8217;s security or platform controls<\/li>\n<\/ul>\n<p>Apta may take action against accounts that misuse communication features.<\/p>\n<hr \/>\n<h1>12. User Conduct<\/h1>\n<p>You agree not to:<\/p>\n<ol>\n<li>Use Apta for unlawful purposes.<\/li>\n<li>Create fake or misleading profiles.<\/li>\n<li>Impersonate another person or organization.<\/li>\n<li>Provide false professional qualifications.<\/li>\n<li>Manipulate ratings or reviews.<\/li>\n<li>Create multiple accounts to abuse the platform.<\/li>\n<li>Use automated systems, bots, crawlers, or scraping tools without authorization.<\/li>\n<li>Attempt to gain unauthorized access to Apta systems.<\/li>\n<li>Upload viruses, malware, or malicious code.<\/li>\n<li>Interfere with the operation of Apta.<\/li>\n<li>Circumvent security mechanisms.<\/li>\n<li>Harvest or collect user information without authorization.<\/li>\n<li>Use Apta to facilitate fraud or scams.<\/li>\n<li>Upload content that infringes another person&#8217;s intellectual property rights.<\/li>\n<li>Publish unlawful, threatening, defamatory, obscene, or abusive content.<\/li>\n<li>Use Apta to discriminate against people in violation of applicable law.<\/li>\n<li>Misuse Apta&#8217;s branding, content, data, or technology.<\/li>\n<li>Attempt to manipulate Apta search rankings, trust indicators, reviews, or verification systems.<\/li>\n<\/ol>\n<hr \/>\n<h1>13. Reviews and Ratings<\/h1>\n<p>Apta may allow customers and providers to submit ratings and reviews.<\/p>\n<p>Reviews should reflect genuine experiences.<\/p>\n<p>Users must not:<\/p>\n<ul>\n<li>Submit fake reviews<\/li>\n<li>Pay or offer incentives for misleading reviews<\/li>\n<li>Review a transaction or interaction that did not occur<\/li>\n<li>Threaten another user to obtain or remove a review<\/li>\n<li>Manipulate ratings<\/li>\n<li>Create multiple accounts to influence ratings<\/li>\n<li>Post confidential or sensitive information about another person<\/li>\n<\/ul>\n<p>Apta may remove reviews that violate these Terms or applicable policies.<\/p>\n<p>Apta does not guarantee that every review is accurate or represents the views of Apta.<\/p>\n<hr \/>\n<h1>14. User-Generated Content<\/h1>\n<p>Users may upload or publish content including:<\/p>\n<ul>\n<li>Photographs<\/li>\n<li>Videos<\/li>\n<li>Text<\/li>\n<li>Reviews<\/li>\n<li>Service descriptions<\/li>\n<li>Portfolio material<\/li>\n<li>Comments<\/li>\n<li>Profile information<\/li>\n<\/ul>\n<p>You retain ownership of content that you own.<\/p>\n<p>By submitting content to Apta, you grant Apta a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, format, and otherwise use that content as reasonably necessary to operate, improve, promote, and provide Apta&#8217;s services.<\/p>\n<p>You represent that:<\/p>\n<ul>\n<li>You have the necessary rights to submit the content.<\/li>\n<li>The content does not violate applicable law.<\/li>\n<li>The content does not infringe another person&#8217;s rights.<\/li>\n<li>The content does not contain unauthorized personal or confidential information.<\/li>\n<\/ul>\n<hr \/>\n<h1>15. Intellectual Property<\/h1>\n<p>Apta and its licensors own or control the intellectual property associated with the Apta platform, including where applicable:<\/p>\n<ul>\n<li>Apta name and branding<\/li>\n<li>Logos<\/li>\n<li>Website design<\/li>\n<li>Application design<\/li>\n<li>Software<\/li>\n<li>Source code<\/li>\n<li>Graphics<\/li>\n<li>Text<\/li>\n<li>Icons<\/li>\n<li>Platform architecture<\/li>\n<li>User interface<\/li>\n<li>Apta-created content<\/li>\n<li>Trademarks and service marks<\/li>\n<\/ul>\n<p>Except as expressly permitted, you may not:<\/p>\n<ul>\n<li>Copy<\/li>\n<li>Reproduce<\/li>\n<li>Modify<\/li>\n<li>Distribute<\/li>\n<li>Sell<\/li>\n<li>License<\/li>\n<li>Reverse engineer<\/li>\n<li>Create derivative works from<\/li>\n<li>Extract substantial portions of<\/li>\n<\/ul>\n<p>Apta&#8217;s intellectual property without prior written permission.<\/p>\n<hr \/>\n<h1>16. Third-Party Services<\/h1>\n<p>Apta may integrate with third-party services such as:<\/p>\n<ul>\n<li>Maps<\/li>\n<li>Identity verification providers<\/li>\n<li>SMS\/OTP providers<\/li>\n<li>Cloud infrastructure<\/li>\n<li>Analytics services<\/li>\n<li>Communication services<\/li>\n<li>Social media platforms<\/li>\n<li>Payment providers<\/li>\n<li>Other technology providers<\/li>\n<\/ul>\n<p>Use of third-party services may be subject to their own terms and privacy policies.<\/p>\n<p>Apta is not responsible for the independent operation or policies of third-party services.<\/p>\n<hr \/>\n<h1>17. External Links<\/h1>\n<p>Apta may contain links to third-party websites or services.<\/p>\n<p>Such links are provided for convenience.<\/p>\n<p>Apta does not necessarily endorse or control third-party websites and is not responsible for their content, availability, security, or privacy practices.<\/p>\n<hr \/>\n<h1>18. Safety and User Responsibility<\/h1>\n<p>Apta may introduce verification and trust features intended to help users make informed decisions.<\/p>\n<p>However, users remain responsible for taking reasonable precautions when interacting with another person.<\/p>\n<p>Customers may consider:<\/p>\n<ul>\n<li>Checking provider identity<\/li>\n<li>Reviewing provider information<\/li>\n<li>Confirming qualifications where relevant<\/li>\n<li>Confirming pricing<\/li>\n<li>Confirming scope of work<\/li>\n<li>Meeting in an appropriate environment<\/li>\n<li>Avoiding unnecessary sharing of sensitive information<\/li>\n<li>Using appropriate safety precautions<\/li>\n<\/ul>\n<p>Providers should also take reasonable precautions when visiting customers or performing services.<\/p>\n<p>Apta does not guarantee the personal safety of users or the conduct of another user.<\/p>\n<hr \/>\n<h1>19. Prohibited Services and Activities<\/h1>\n<p>Apta may prohibit or restrict certain services, products, activities, or categories.<\/p>\n<p>Users must not use Apta for services or activities that are:<\/p>\n<ul>\n<li>Illegal<\/li>\n<li>Fraudulent<\/li>\n<li>Deceptive<\/li>\n<li>Dangerous<\/li>\n<li>Prohibited by applicable law<\/li>\n<li>In violation of third-party rights<\/li>\n<li>Otherwise restricted by Apta<\/li>\n<\/ul>\n<p>Apta may remove listings or suspend accounts where necessary.<\/p>\n<hr \/>\n<h1>20. Local Suppliers and Recurring Services<\/h1>\n<p>Apta may list providers offering recurring or local services such as:<\/p>\n<ul>\n<li>Water delivery<\/li>\n<li>Milk delivery<\/li>\n<li>Newspaper delivery<\/li>\n<li>Laundry<\/li>\n<li>Ironing<\/li>\n<li>Tiffin services<\/li>\n<li>Local transport<\/li>\n<li>Household assistance<\/li>\n<li>Gardening<\/li>\n<li>Waste collection<\/li>\n<li>Local delivery<\/li>\n<li>Other recurring or local services<\/li>\n<\/ul>\n<p>Availability, delivery schedules, prices, service areas, and quality are determined by the respective provider unless Apta expressly states otherwise.<\/p>\n<hr \/>\n<h1>21. Influencers, Creators and Freelancers<\/h1>\n<p>Apta may allow creators and professionals such as:<\/p>\n<ul>\n<li>Instagram influencers<\/li>\n<li>YouTubers<\/li>\n<li>Content creators<\/li>\n<li>UGC creators<\/li>\n<li>Photographers<\/li>\n<li>Videographers<\/li>\n<li>Bloggers<\/li>\n<li>Podcasters<\/li>\n<li>Freelancers<\/li>\n<li>Consultants<\/li>\n<\/ul>\n<p>to create professional profiles.<\/p>\n<p>Any follower count, engagement metric, portfolio information, pricing, collaboration history, or other information displayed on such profiles may be supplied by the provider or obtained through applicable verification mechanisms.<\/p>\n<p>Apta does not guarantee the accuracy of every creator metric or the outcome of a marketing collaboration.<\/p>\n<p>Users should independently agree on campaign requirements, deliverables, usage rights, timelines, payment terms, and other commercial conditions.<\/p>\n<hr \/>\n<h1>22. No Guarantee of Results<\/h1>\n<p>Apta does not guarantee:<\/p>\n<ul>\n<li>A particular number of enquiries<\/li>\n<li>A particular number of customers<\/li>\n<li>A particular number of quotes<\/li>\n<li>Successful completion of a service<\/li>\n<li>Business growth<\/li>\n<li>Marketing results<\/li>\n<li>Sales<\/li>\n<li>Leads<\/li>\n<li>Customer satisfaction<\/li>\n<li>Specific search rankings<\/li>\n<li>Availability of any provider<\/li>\n<\/ul>\n<p>Apta&#8217;s role is primarily to facilitate discovery, communication, and connection.<\/p>\n<hr \/>\n<h1>23. Disputes Between Customers and Providers<\/h1>\n<p>Where a dispute arises between a customer and a service provider, the parties should first attempt to resolve the matter directly.<\/p>\n<p>Disputes may relate to:<\/p>\n<ul>\n<li>Price<\/li>\n<li>Quality of work<\/li>\n<li>Delayed service<\/li>\n<li>Cancellation<\/li>\n<li>Damage<\/li>\n<li>Misrepresentation<\/li>\n<li>Payment<\/li>\n<li>Scope of work<\/li>\n<li>Conduct<\/li>\n<li>Refunds<\/li>\n<\/ul>\n<p>Unless expressly stated otherwise, Apta is not a party to the underlying service agreement between the customer and provider.<\/p>\n<p>Apta may, at its discretion, assist with communication, review relevant platform information, or take action against accounts that violate Apta policies.<\/p>\n<p>Such assistance does not make Apta responsible for the underlying service.<\/p>\n<hr \/>\n<h1>24. Account Suspension and Termination<\/h1>\n<p>Apta may suspend, restrict, deactivate, or terminate an account where we reasonably believe that a user:<\/p>\n<ul>\n<li>Violates these Terms<\/li>\n<li>Violates applicable law<\/li>\n<li>Provides false information<\/li>\n<li>Engages in fraud<\/li>\n<li>Abuses other users<\/li>\n<li>Manipulates reviews<\/li>\n<li>Misuses verification<\/li>\n<li>Attempts to compromise platform security<\/li>\n<li>Creates risk to Apta or other users<\/li>\n<\/ul>\n<p>We may also remove individual listings, content, reviews, or services.<\/p>\n<p>Users may stop using Apta at any time.<\/p>\n<hr \/>\n<h1>25. Disclaimer of Warranties<\/h1>\n<p>To the maximum extent permitted by applicable law, Apta is provided on an &#8220;as is&#8221; and &#8220;as available&#8221; basis.<\/p>\n<p>Apta does not warrant that:<\/p>\n<ul>\n<li>The platform will always be available.<\/li>\n<li>The platform will be error-free.<\/li>\n<li>Search results will always be accurate.<\/li>\n<li>Provider information will always be complete or current.<\/li>\n<li>Every provider is qualified or trustworthy.<\/li>\n<li>A service will be completed successfully.<\/li>\n<li>A provider will meet a customer&#8217;s expectations.<\/li>\n<li>The platform will be uninterrupted or completely secure.<\/li>\n<\/ul>\n<p>Apta does not provide warranties regarding services independently provided by third-party service providers.<\/p>\n<hr \/>\n<h1>26. Limitation of Liability<\/h1>\n<p>To the maximum extent permitted by applicable law, Apta and its directors, employees, officers, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:<\/p>\n<ul>\n<li>Use of or inability to use Apta<\/li>\n<li>Interaction between customers and providers<\/li>\n<li>Services provided by independent providers<\/li>\n<li>Provider conduct<\/li>\n<li>Customer conduct<\/li>\n<li>Information supplied by users<\/li>\n<li>Loss or damage resulting from transactions between users<\/li>\n<li>Unauthorized access beyond Apta&#8217;s reasonable control<\/li>\n<li>Third-party services<\/li>\n<li>Communications between users<\/li>\n<\/ul>\n<p>Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.<\/p>\n<hr \/>\n<h1>27. Indemnification<\/h1>\n<p>To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Apta, TechDost Services Private Limited, and their directors, officers, employees, affiliates, and representatives from claims, losses, liabilities, damages, costs, and expenses arising from:<\/p>\n<ul>\n<li>Your violation of these Terms<\/li>\n<li>Your misuse of Apta<\/li>\n<li>Your violation of applicable law<\/li>\n<li>Your content<\/li>\n<li>Your interaction with another user<\/li>\n<li>Your services provided through Apta<\/li>\n<li>Your infringement of another person&#8217;s rights<\/li>\n<\/ul>\n<hr \/>\n<h1>28. Changes to Apta<\/h1>\n<p>Apta may modify, add, suspend, or discontinue features from time to time.<\/p>\n<p>We may introduce new services, remove existing features, modify search functionality, change provider tools, or introduce new payment or monetization features.<\/p>\n<p>Where required, we will provide appropriate notice of material changes.<\/p>\n<hr \/>\n<h1>29.
